Summary
This summary is for convenience only. The full Terms below are what apply.

- On the Free plan, conversations, project files, generated outputs and memories are deleted from the cloud after 60 days. Your books are not.
- Subscriptions renew automatically until you cancel them in the app store.
- You can delete your account and all of your data at any time.
1. Who we are and what these Terms cover
1.1 These Terms of Service ("Terms") are an agreement between you and Kairn ("we", "us"). They govern your use of the Kairn apps for phones, tablets and computers, our websites, and the related cloud services (together, the "Service").
1.2 By creating an account, signing in, or using the Service, you agree to these Terms and acknowledge our Privacy Policy, which explains how we handle personal data. If you do not agree, do not use the Service.
1.3 If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.
2. Eligibility and accounts
2.1 Age. You must be at least 13 years old, or the minimum age required in your country to consent to the use of online services (for example, 16 in some EU member states), whichever is higher. If you are under 18, or under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. We do not knowingly collect personal data from children under 13.
2.2 Signing in. You can sign in with an email verification code, with a third-party account, or with other methods we offer. Please give accurate information and keep access to your email account and devices secure.
2.3 Your account is personal. Do not share, sell or transfer your account, and do not use anyone else's. You are responsible for activity under your account unless it results from our fault. Tell us promptly if you think someone else has accessed it. You can see your signed-in devices in Settings and sign any of them out.
2.4 Deleting your account. You can ask us to delete your account at any time by writing to the address in section 17; we will first confirm it is you. When you delete your account:
- we delete your account and all of its content within 30 days, except what the law requires us to keep;
- any remaining subscription time, unused allowances and referral rewards end;
- deleting your account does not cancel a subscription bought through an app store. Cancel it there first to avoid further charges.
3. The Service
3.1 Kairn is a tool for learning and building knowledge. With it you can:
- add material by taking photos, uploading files, recording audio, pasting text, sharing from other apps, and chatting;
- have Kairn's AI author organize the material on one topic into a book of volumes, chapters and sections, and keep that book up to date as new material arrives;
- create, edit, delete and reorder volumes, chapters and sections yourself;
- chat with an AI that answers from, and cites, your own books;
- generate outputs from your books, such as mind maps, slide decks and podcast-style audio;
- sync your library across your signed-in devices;
- connect Kairn to other AI apps you use (see Section 9).
3.2 Features, usage allowances and limits depend on your plan (see Section 8) and are described in the app.
3.3 We keep improving Kairn, so features may be added, changed or removed. If a change significantly reduces what you have paid for, we will tell you in advance, and where required by law, we will offer a pro-rata refund or allow you to cancel.
4. AI features
4.1 AI output can be wrong. Books, answers, summaries and other outputs ("Output") are generated automatically from your material and instructions by AI models. Output may be inaccurate, incomplete or out of date, or may not faithfully reflect your source material. Output is not professional advice (medical, legal, financial, psychological or otherwise). Check it before relying on it for anything important. Each section in a book links to the material it was written from, so you can verify it.
4.2 Books are rewritten. When new material arrives, the AI author may merge it into existing sections or reorganize the book, and the affected text may change. You can edit or delete anything in your books yourself.
4.3 AI-generated content. The books and other outputs in Kairn are generated by AI from your material. If you publish or share Output, do not present it as human-created where that would mislead people. In particular, AI-generated audio or images that could be mistaken for real people or events must be disclosed as AI-generated.
4.4 Partners. To provide AI features, we share what is needed to complete your request with partners who provide services to us. Our Privacy Policy explains more.
4.5 No training on your content. We do not use your content or your Output to train AI models. If this ever changes, we will ask for your explicit consent first.
4.6 Similar output. Because of how AI works, other users may receive Output that is similar or identical to yours. Rights to your Output do not extend to other people's similar Output.
5. Your content
5.1 You own your content. Everything you submit ("Your Material") and the Output generated for you (together, "Your Content") belongs to you or your licensors. To the extent we have any rights in your Output, we assign them to you. Whether Output is protected by copyright depends on the law where you are.
5.2 Permission you give us. You give us a worldwide, non-exclusive, royalty-free license to store, process and display Your Content to you, and to have it processed by partners who provide services to us. This license is only for operating, securing and providing the Service to you. It does not allow us to publish Your Content, sell it, or use it for advertising. The license ends when you delete the content or your account.
5.3 Your responsibility. You confirm that you have the rights needed to submit Your Material. This includes permission from others whose personal data, images or copyrighted works appear in it. Your Material and your use of Output must not break the law or the Acceptable Use rules in Section 6.
5.4 Backups. We take reasonable measures to protect your data. We still recommend keeping your own copies of important originals and exporting your books from time to time.
5.5 Feedback. If you send us suggestions or feedback, we may use them without any obligation to you.
6. Acceptable use
6.1 You must not use the Service to create, upload, store or share content that:
- is illegal, or promotes or facilitates illegal activity;
- sexually exploits or endangers children;
- infringes intellectual property, privacy, publicity or other rights of others;
- is defamatory, harassing, hateful or threatening, or incites violence;
- is intended to deceive people, including impersonation, fraud, and deceptive deepfakes of real people;
- contains malware or harmful code.
6.2 You must not:
- attempt to bypass the safety measures of our AI features, or use them to produce content that is prohibited above;
- use Output to develop AI models that compete with Kairn;
- probe, attack or disrupt the Service, or use a security weakness to gain unfair benefit;
- scrape the Service or access it by automated means, other than in ways we provide, such as connecting other AI apps;
- circumvent plan limits, resell access or allowances, or create accounts in bulk;
- abuse the referral program, for example by creating fake accounts;
- copy, modify, reverse engineer, decompile or disassemble the apps, except where the law expressly allows it despite this restriction.
6.3 How we enforce these rules. We do not routinely review the private content in your library. We act on reports and legal notices. Enforcement decisions are made by a person. If we find a violation, we may:
- remove or disable the content;
- restrict features;
- suspend or terminate your account;
- report illegal content to the authorities where the law requires.
We will tell you what we did and why, and which rule it relates to, unless the law prevents us or doing so would create a security risk. You can ask us to review the decision by writing to support@kairnbook.com within 6 months. A person who was not involved in the original decision will review it and reply.
7. Intellectual property complaints
If you believe content on the Service infringes your copyright or other rights, send a notice to support@kairnbook.com with:
- your contact details;
- a description of the work or right concerned;
- where the content is located, as precisely as you can;
- a statement that you believe in good faith that the use is not authorized;
- a statement that the information in the notice is accurate and, for copyright notices, that you are authorized to act for the rights holder;
- your physical or electronic signature.
We will review valid notices promptly and tell the affected user. The user may respond with a counter-notice. We terminate the accounts of repeat infringers where appropriate.
8. Plans, subscriptions and payments
8.1 Plans. Kairn offers a Free plan and paid plans (currently Plus and Pro). Plans differ in features and usage allowances, as shown in the app.
8.2 Free plan cloud retention. On the Free plan, conversations, project files, generated outputs, memories and settings stored in the cloud are deleted automatically 60 days after they were created. Your books and the original files you uploaded are not deleted. To keep everything, upgrade or export your content.
8.3 Monthly allowances. AI usage allowances reset each calendar month. Unused allowance does not carry over. When an allowance runs out, the related features pause until the next month or until you upgrade.
8.4 Purchases. Paid plans are sold as in-app subscriptions through app stores. The app store processes the payment, and its terms also apply. The price, the billing period and any taxes are shown before you confirm the purchase.
8.5 Automatic renewal. Your subscription renews automatically at the end of each billing period, and you are charged the then-current price, unless you cancel at least 24 hours before the period ends. You can cancel at any time in your app store subscription settings. After you cancel, you keep your paid features until the end of the current period. We will notify you before a price increase takes effect, and where required by law, we will ask for your consent to it.
8.6 Refunds. Refunds for in-app purchases are handled by the app store under its policies. If you are a consumer in the EU, the UK or another country that gives you a right of withdrawal or other refund rights, nothing in these Terms limits those rights.
8.7 Referral rewards. When someone you invite signs up and completes their first conversation, you and they each receive 7 days of Plus. During this trial, the AI usage allowance is lower than on a paid Plus plan. Rewards have no cash value and cannot be transferred. We may withdraw rewards obtained through fake or duplicate accounts.
8.8 When a paid plan or trial ends. Your account returns to the Free plan. We do not delete your books. However, you may not be able to create new content beyond the Free limits, and the Free plan cloud retention period (Section 8.2) applies from that date.
9. Third-party services and connecting other AI apps
9.1 Some features of the Service are provided by third parties under their own terms.
9.2 Connecting other AI apps. You can authorize other AI apps you use to read your library or save content into it. After you grant access, that app's handling of your data is governed by its provider's terms and privacy policy, not ours. Only connect apps you trust. You can disconnect Kairn in that app at any time.
9.3 The Service may link to third-party websites. We are not responsible for their content.
10. Availability, changes and termination
10.1 We work to keep the Service available, but it may sometimes be unavailable because of maintenance, updates, failures of networks or third-party services, attacks or other events beyond our control. Where possible, we will announce planned maintenance in advance.
10.2 If we shut down the Service, we will give you at least 30 days' notice in the app and a way to export your books. We will also refund any prepaid subscription time that has not been used, as required by law.
10.3 You can stop using the Service at any time and delete your account (Section 2.4).
10.4 We may suspend or terminate your access if you seriously or repeatedly breach these Terms, if the law requires it, or to protect users or the Service. Section 6.3 describes how we do this. Sections 5.1, 5.5, 11, 12, 15 and 16 survive termination.
11. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available". We make no warranties beyond those stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service or any Output will be uninterrupted, error-free or accurate. Some jurisdictions do not allow these exclusions. If you are a consumer, you keep any rights that cannot be excluded under the laws of your country, including statutory guarantees that digital content and services conform to the contract.
12. Limitation of liability
12.1 To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or goodwill.
12.2 To the extent permitted by law, our total liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) USD 100 or the equivalent in your local currency.
12.3 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for our intentional misconduct or gross negligence, or for any other liability that cannot be limited or excluded by law. If you live in the EU or the UK, we are liable for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care and skill.
13. Indemnity
To the extent permitted by law, you agree to compensate us for reasonable costs and losses, including reasonable legal fees, arising from third-party claims caused by your illegal use of the Service or by Your Material infringing someone else's rights. This does not apply to the extent the claim is caused by our own fault. If you are a consumer in the EU or the UK, this section applies only to the extent permitted by the consumer law of your country.
14. Changes to these Terms
We may update these Terms, for example to reflect new features or changes in law. If a change materially affects your rights, we will notify you in the app or by email at least 30 days before it takes effect, and where required by law, we will ask for your consent. If you do not agree, you can stop using the Service and delete your account before the change takes effect. Other changes take effect when we publish them.
15. Governing law and disputes
15.1 These Terms are governed by the laws of the People's Republic of China (for the purposes of these Terms, excluding the laws of Hong Kong, Macao and Taiwan), excluding its conflict-of-laws rules.
15.2 Before starting a formal dispute, please contact us at support@kairnbook.com so we can try to resolve it informally within 30 days.
15.3 Any dispute that is not resolved informally will be decided by the competent people's court where the operator is domiciled.
15.4 If you are a consumer, you also benefit from the mandatory protections of the law of the country where you live, and you may bring proceedings in the courts of that country. Consumers in the EU may also use the European Commission's online dispute resolution information and their national consumer bodies.
16. General
16.1 Entire agreement. These Terms, together with the Privacy Policy and any plan terms shown at purchase, are the entire agreement between you and us about the Service.
16.2 Severability. If any provision is found invalid or unenforceable, the rest of these Terms remain in effect.
16.3 No waiver. If we do not enforce a provision, we have not waived our right to enforce it later.
16.4 Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours to a successor that continues to provide the Service, provided your rights are not reduced. We will notify you if we do.
16.5 Export and sanctions. You confirm that you are not located in a country or region subject to comprehensive sanctions, and are not on any government list of restricted parties, that would prohibit us from providing the Service to you.
16.6 Language. These Terms are written in English and may be translated. If a translation conflicts with the English version, the English version prevails, unless the law of your country requires otherwise.
16.7 Notices. We may send you notices in the app or to the email address on your account.

Appendix A: Additional terms for app store downloads
If you downloaded Kairn from an app store, the following terms also apply:
- These Terms are between you and us only, not with the operator of the app store. We are solely responsible for the app and its content.
- Your license to use the app is limited to the uses permitted by that app store's usage rules.
- We are solely responsible for providing maintenance and support. The app store operator has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may request a refund of the purchase price, if any, under that app store's rules. To the maximum extent permitted by law, the app store operator has no other warranty obligation with respect to the app.
- We, not the app store operator, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app, or your possession and use of it, infringes that third party's intellectual property rights, we, not the app store operator, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in an embargoed country or region and that you are not listed on any government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the app.
- Where the app store's rules require it, the app store operator and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
